Family Blames Nursing Home Neglect For Mother?s Death

Within a few months from making the transition into assisted living at the Buena Vida?nursing?home in San Antonio, Texas, 94 year old Consepcion De La Garza died. According to certain?De La Garza family members there are cell phone videos taken in their mother?s final days that show her rapid decline from elder abuse.

In her final weeks, De La Garza complained about back problems. Well that was because part of her back was being exposed and she died of sepsis, a?severe illness develops when the bloodstream is overwhelmed by bacteria, often from bedsores. In addition to the sepsis, there was mold found under her breast, which could mean she was not being bathed regularly and probably was a victim of?neglect by a caretaker.

The Buena Vida elder care facility scored a 50 out of 100 well under the state average of 67. Unfortunately, a state law passed in 2003 put a $250,000 cap on elder abuse?lawsuit payouts involving nursing homes and elder care facilities and as a result many law firms cannot afford to take on clients nor their cases.
